WHAT IS THE DEMOCRACY DEFINED CAMPAIGN ? To appreciate the importance to the citizen and to civilisation at large of the underlying recondite aspects of Trial by Jury, i.e. "the judgement of peers," (i.e. peers are one’s social-equals; not government employees or representatives) and how this Justice System works, see previous Campaign pages 1, 2, 3, & 4. Read how, for criminal motives, Trial by Jury is denied or has been interfered with and undermined by governments. Adopted as law (universally) our Campaign requires trial judges to resume their former practice of instructing jurors of all their duties (as mentioned on the first Campaign Philosophy page). In Trial by Jury, the proper functions and duties of citizens as jurors are: to judge the law; the facts; on the admissibility of all the evidence (i.e. evidence not being pre-selected by the judge); the moral intent of the accused (whose actions require to have been committed with malice aforethought to find ‘guilt’); mitigating circumstances; and where guilt is unanimously found, the suitability of the sentence (no mandatorily prescribed penalties), in every contested civil, criminal and fiscal court case. In Constitutional Common Law Trial by Jury, it is the Citizen-Juror’s Duty to judge the justice of every act of law enforcement, and to render the Not Guilty Verdict whenever conviction or punishment of the accused would be unfair according to the juror’s conscience. "The Jury has the power to bring a
verdict in the teeth of both law and fact." In this matter, good men and women who stand up against tyranny are of one mind. "If you will not fight for right when you
can easily win without bloodshed; if you will not fight when your victory will be sure and
not too costly; you may come to the moment when you will have to fight with all odds
against you and only a precarious chance of survival. There may be even a worse fate.
You may have to fight when there is no hope of victory, because it is better to perish than
to live as slaves." Today, this duty of the Jurors—which is definitive of Trial by Jury, sine qua non—is illegally denied by government and judges’ interference, to enable the unlawful enforcement of inequitable and venal legislation. ADOPTION OF The British and American public and all like-minded Europeans, and the People of all countries, working with and leading the U.N.O., can edify and emancipate their fellow-citizens into achieving RESTORATION and UNIVERSAL ADOPTION of the nonpareil constitution: The Constitutional Common Law Trial by Jury Justice System. Only then do worldwide elimination of tyrannies and the Crimes Against Humanity by politicians and governments, and permanent relative peace on Earth become feasible. By Universal Adoption, we transnationally bequeath to future generations the Democratic Safeguards, laws, rights and personal protection to which all men and women are entitled; and set an example for emulation by posterity. May Universal Adoption be swiftly achieved as the result of educative democratic political activity by all the Peoples of the World. The DEMOCRACY DEFINED CAMPAIGN invites all citizens everywhere to become active in our Campaign: to unite in solidarity behind civilised values in order to repel the encroachments of state tyranny; and to mount responsible effective resistance to the modern resurgent political despotism.In this modern era of mass electronic communications, achieving these aims is practicable. In the U.S. and the U.K., these are constitutionally-established, but they are intrinsic to every human being.For example, did you know that the Common Law Trial by Jury Justice System gives power to ordinary people as jurors to decide to annul the prosecution or enforcement of any law whenever the juror considers that conviction or punishment of the accused would be unfair and wrong. This is part of our U.S. and U.K. constitutions. Yet, many people are ignorant of this vital legal protection against injustices inflicted by the state and by courts (judges). Today, rather than the jurors, while government judges run trials, real criminals do not receive appropriate retributive sentences, or go free, and harmless innocent citizens in their thousands are abused, fined and incarcerated. Increasingly, citizens all over the Western world are being persecuted by governments’ employees for normal actions and everyday activities which are not crimes. This can only happen because governments have illegally denied the Citizens’ protections ensured by the Trial by Jury, whereby, in finding their Verdict, jurors judge on the justice of law and its enforcement. The pernicious calumny that England (or Britain)
has "no constitution," is promulgated today by individuals of
parliament and judiciary, to obscure their routine violation of the
35 times ratified Constitution by which they are bound. In order to enable governments (of any political background) to enforce unjust money-motivated special interest ‘laws’ which would be annulled by Citizen-Jurors (i.e., made unenforceable by Jurors’ refusal to find the undeserved ‘guilty’ verdicts), the Juror’s Right to annul is concealed by governments, forbidden by judges, and our Jury Rights and Duties are deliberately not taught by the state education system."There are more instances of the abridgement of the freedom of the people by gradual and silent encroachments of those in power than by violent and sudden usurpations." Without it, every kind of injustice becomes enforceable and tyranny unstoppable (by peaceful means). So, your country, your people, and THE DEMOCRACY DEFINED Campaign need YOU.ALONGSIDE TRIAL BY JURY, Removal from the jurors of their judgement on justice and equity issues transforms Trial by Jury into the unlawful, one-sided, unfair mistrial-by-government-judges, the method by which tyrannies thrive. This system enables and obliges judges to enforce every persecution, stealth-tax, oppression, money-motivated subterfuge and injustice government introduces, and which judges then lawlessly claim is "the law." If the exemplary human achievement of the Common Law Trial by Jury Justice System had been kept in place (for other nations of the World to emulate), the West would never have experienced much corruption and real crime; and, for centuries, tyrannies, local wars and extreme governments would all have been precluded. The World would have been a different and a better place in which to have lived, and the future would be looked forward to with confidence, pleasure, optimism and satisfaction. CONSTITUTIONAL DEMOCRACIES’ TRIAL BY JURY The continuing illegal act by governments of denying and/or destroying Common Law Trial by Jury is the gravest of crimes which calls for utmost RESISTANCE: all Citizens have the Right and the Duty to take appropriate actions to terminate the crime and tyranny, and to achieve RESTORATION and Universal Adoption. Mankind will not, and cannot, find the psychological and social environment acceptable until Common Law Trial by Jury is Restored and Universally Adopted. You might have experienced injustices yourself, or know friends or family members who have. You might be justifiably angry and not know how to seek justice and obtain redress. The number of citizens who feel they have been "hard-done-by" is growing daily, because in every rank of the government apparatus, state employees abuse the powers bestowed on them and make use of tyrannical "bully-boy" tactics. Without the Trial by Jurors to guard the individual and thus the entire population, the human predisposition for tyranny is unleashed: real power, subtracted from citizen-juries, devolves to every level of the state apparatus. From traffic warden, town clerk, or junior patrolman, to the justices, to the chief executive, all ranks are ceaselessly exposed to carnal and financial temptations: of utilising bullying, bribery, coercion and fear, over ordinary citizens, to flagitious advantage. Without exception, the resulting corruption is witnessed in (and definitive of) every tyranny. Barbarian states, such as the Chinese communist and Soviet-style
tyrannies, purblind intolerance and inhumanity (as also exemplified by the sebastomaniac
‘religious’ organisations and states *), are brought into
being inevitably by disregard for and denial of the universally fair common law
Trial by Jury Justice System. Truth, Knowledge, Justice and Liberty are suppressed
in the statists’ frozen, fearful society. Inexorably, the West is visibly metamorphosing
into a cultural tundra and in the dismal process, losing its moral ascendant of
millennia. Only RESTORATION will reverse the morbid decline. In a Constitutional Democracy, that is, a system of government controlled by the traditional European and Anglo-American type of constitution incorporating and based on Trial by Jury, it is the unalterable duty of government to uphold people’s sovereign right to seek their own individually-defined self-fulfilment. Trial by Jury ensures that the government is controlled and society arranged so as to allow every innocent citizen unmolested tranquillity of existence and the pursuit of happiness. In starkest contrast, the state-trial system psychologically detaches the personnel within its apparatus from the ordinary citizens. In this socially and mentally distorted environment, the reign of terror gestates. It adversely affects everyone, perverting those who govern and sorely oppressing the governed. All concentration-camp guards in the making: commissioners, politicians, bureaucrats, judiciary, police and prison service are thrust into a condemnatory overlordship of the ordinary citizen. Let there be no mistaking the issue. There is no such thing as a ‘benevolent dictator’, which everyone learns to their cost who disagrees with the autocrat’s will. Yet, in the totalitarian state, in each individual court-case, autocratic power over citizens is given to every judge. That is, in the totalitarian state (whether political or ‘religious’), despotic power is held over citizens by the state’s judges: and citizens do not have the constitutional authority to annul injustices. Politicians and judges have the corrupting absolute power to decide people’s liberty for them. The result of allowing individuals or states to have such power over citizens is, without exception, always the same: democracy, decency, liberty, the cultivation of virtues and the pursuit of happiness are obliterated. As if any further evidence were necessary to prove the point, consider the following quotation from Part Seven of the DEMOCRACY DEFINED publication, THE REPORT ISBN 9781902848167: "As is visible everywhere, the less citizens’ control there is of government, the more extreme the tyranny extant. The converse is also true: the greater the tyranny, the less there is democratic control. History, and dispassionate reflection on the world today, teach no more certain lesson than this: Whenever and wherever Trial by Jury is not in place, or it is allowed by the population to be interfered with by government and its representatives, there tyranny and crime inevitably prevail." What if Americans, the British, Europeans, and other people across the globe learn about the real democratic Trial by Jury constitution ? Will they then insist their representatives serve them and democracy ? and accept nothing less than: RESTORATION and UNIVERSAL ADOPTION. The trial-by-state-judges technique of tyranny requires to be truthfully explained to populations everywhere, for the injustice it embodies, the servility it imposes, and the maelstrom of crime, corruption, misery and strife it always engenders. Given the choice, nowhere is this uncivilised mode acceptable, even to people in the rudest state of development; still less to citizens in a condition of relative enlightenment. Trial by Jury is relevant to every race, nation and society on Earth, bar none.
